Plaintiff is a 35 year old male that was involved in a car accident. The plaintiff was driving his motor vehicle westbound on the Long Island Expressway when he was approaching exit 37 in Mineola, Long Island, New York when a tractor trailer struck a motor vehicle causing that vehicle to subsequently strike the car plaintiff was driving. Plaintiff did not go to the hospital but was treated at an urgent care facility the next morning where he had complaints of lower back pain and right shoulder discomfort. Ultimately plaintiff was determined to be suffering from multiple herniated discs in his lumbar spine and underwent a Lumbar Laminectomy at L4/L5. With regard to his right shoulder, an MRI confirmed a tear of the labrum and a partial tear of the rotator cuff requiring arthroscopic surgery consisting of a partial bursectomy and a subacromial decompression.
