Plaintiff is a 37-year-old female who was at a Deli looking to purchase a Rotisserie Chicken. Plaintiff asked to use the bathroom, but an employee directed her to the wrong door. When the plaintiff opened the door, a bird that was being held captive and tethered to the wall attempted to escape. The bird’s flight was abbreviated due to the tether, yet the bird’s sudden appearance and frantic flapping of its wings startled the plaintiff and caused her to tumble down a steep and grimy staircase.
